Website Terms & Conditions
These terms govern use of the Heart of Texas Tents website. By using the website, you agree to use it lawfully and not to interfere with its operation.
Quotes are not reservations
A quote request submitted through this website is an inquiry only. It does not reserve equipment, create a rental contract, or guarantee availability. A rental becomes confirmed only when Heart of Texas Tents and the customer agree to the applicable rental terms and any required payment or deposit.
Pricing and availability
Prices, availability, delivery charges, setup charges, taxes, deposits, and other terms may vary by event. Information on the website is subject to change without notice and should not be treated as a final quote unless confirmed by us.
Website content
We try to keep the website accurate and current, but photos, descriptions, inventory, availability, and other information may change. Images may show representative setups and do not guarantee that every pictured item or configuration will be included in a particular rental.
Third-party services
The website may use third-party services for form delivery, communications, hosting, analytics, maps, social media, or other functions. Those services may have their own terms and privacy policies.
Limitation of website liability
To the extent permitted by law, Heart of Texas Tents is not responsible for losses arising solely from reliance on incomplete, outdated, or temporarily unavailable website information. Nothing in these terms excludes liability that cannot legally be excluded.
Governing law
These website terms are intended to be governed by the laws of the State of Texas, without regard to conflict-of-law principles, to the extent permitted by law.
Rental Agreement & Rental Rules
Reservation and payment
Equipment is not reserved until the customer receives confirmation from Heart of Texas Tents and completes any required deposit or payment. A quote alone does not hold inventory.
Customer responsibility for the site
The customer is responsible for providing a safe, accessible installation area and for obtaining any property-owner permission or event approvals required for the event. The customer must disclose known site conditions that could affect setup, including underground utilities, sprinklers, slopes, obstacles, restricted access, and unsafe conditions.
Setup and access
Delivery and setup times are coordinated in advance. The customer must provide reasonable access for delivery and pickup. If access or site conditions are unsafe or materially different from what was represented, Heart of Texas Tents may delay, relocate, modify, or decline installation when reasonably necessary for safety.
Weather and force majeure
Outdoor events are affected by weather. Severe weather, storms, flooding, high winds, lightning, governmental orders, natural disasters, or other events beyond reasonable control may affect installation or use. The final rental agreement should specify cancellation, postponement, refund, rescheduling, and safety procedures for these circumstances.
Safety
Customers must follow all setup, occupancy, anchoring, lighting, and equipment-use instructions. Customers may not move, alter, disassemble, attach unauthorized items to, or modify rented equipment without permission. Equipment must not be used in a way that creates an unsafe condition.
Damage, loss, and cleaning
The customer is responsible, subject to the final rental agreement and applicable law, for damage, loss, theft, excessive cleaning, or unauthorized modification of rented equipment occurring during the rental period. Normal wear and tear is not treated as damage.
Tables, chairs, lighting, and accessories
Rented items must be used only for their intended purpose and within stated capacity limits. Customers should not stand on tables or chairs, overload equipment, or use electrical lighting in an unsafe manner.
Cancellation and changes
Cancellation, rescheduling, deposit, weather, and refund terms should be stated in the customer’s signed rental agreement or invoice before payment. Different event types or custom orders may require different terms.
Responsibility and insurance
The final rental agreement should address customer responsibility, property damage, bodily injury, indemnification, insurance requirements when appropriate, and any limitations of liability permitted by Texas law. These provisions should be reviewed by a Texas attorney for your actual business model and insurance coverage.
Entire agreement
The signed rental agreement and related invoice or written confirmation for the event should control over general website descriptions if there is a conflict.
